Fraghab is operated by FRAGHAB LLC, a Michigan limited liability company. We have designated the following agent to receive notices of claimed copyright infringement under 17 U.S.C. section 512(c)(2). This designation is registered with the United States Copyright Office under registration number DMCA-1076966.

Email reaches us fastest and is the preferred route. Notices sent to any other address or inbox may not be actioned.

To be effective under 17 U.S.C. section 512(c)(3), your notice must include all of the following. A notice missing any of these may not be valid, and we may ask you to resend it.

• Your physical or electronic signature
• Identification of the copyrighted work you claim was infringed, or a representative list if there are several
• Identification of the material you claim is infringing, with enough detail for us to find it, including the URL
• Your name, mailing address, telephone number, and email address
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the owner or are authorized to act on the owner's behalf

If you are writing on behalf of the owner, say who you represent and in what capacity.

We review notices in the order they arrive and act on valid ones promptly. Where a notice is valid we remove or disable access to the material, and we notify the member who posted it, passing on your notice so they can respond if they believe the removal was a mistake.

Fraghab is largely a place where members record fragrances they own, so much of what appears here is entered or uploaded by individual collectors. Telling us the URL is what lets us find the specific row rather than guess.

If your content was removed and you believe it was removed in error, or that you have the right to post it, you may send a counter-notice to the agent above. It must contain all of the following.

• Your physical or electronic signature
• Identification of the material that was removed and where it appeared before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
• Your name, mailing address, and telephone number
• Your consent to the jurisdiction of the federal district court for the district where you live, or the Eastern District of Michigan if you live outside the United States
• Your agreement to accept service of process from the person who filed the original notice

We forward valid counter-notices to the original claimant. We may restore the content in ten to fourteen business days unless the claimant tells us they have filed a court action seeking to restrain the activity.

We terminate the accounts of members who repeatedly infringe, in appropriate circumstances and at our discretion. We keep a record of notices we receive and act on so that repeat behaviour is visible rather than treated as a series of unrelated incidents.

Under 17 U.S.C. section 512(f), knowingly misrepresenting that material is infringing, or that it was removed by mistake, can make you liable for damages and costs, including legal fees. We may also restrict an account that repeatedly files bad-faith notices.

If you are unsure whether something is actually infringing, talking to a lawyer first is worth more than sending a notice and finding out afterwards.

Where a member adds a fragrance by pasting a reference link, Fraghab may store a copy of the bottle image at that member's direction so the entry has a picture. We record where each imported entry came from, which means a notice naming a specific work can be matched to the entries it affects and acted on precisely.

If you are a fragrance house and would rather supply your own imagery and product data than have collectors enter it, we would prefer that too. Our house program exists for exactly that, and it is free.
